Partner Richard Conn leads Musick Peeler team to win a successful ruling in a probate trial
Partners Richard Conn, Erin Donovan and paralegal Linda Tomita received a ruling from the probate court invalidating an estate plan executed by the daughter of Musick Peeler’s client, Genita Johnson, five days before her daughter’s death. The ruling was rendered in Ms. Johnson’s favor notwithstanding her execution of the estate plan as a co-trustee. The adverse parties were so sure of success that they refused to offer more than $10,000 in settlement. Musick Peeler’s client will receive an additional $750,000 from her daughter’s estate as a result of the ruling. Key to the success was Ms. Donovan’s successful opposition to three ex parte applications by adverse counsel to continue the trial date.
