Orange County partner Rosemary K. Nunn, along with her team comprised of attorneys Natasha M. Wu and Nicholas W.T. Fortino, paralegal Krystal Luna, and legal secretary Gaylene Oyama, obtained a multi-million dollar win for their client, a produce distribution company. The commercial construction defect case arose out of the development of a 143,000 square foot, $25,000,000 cold storage facility built in 2015. The client had experienced significant electrical and mechanical problems since turnover, resulting in equipment failures and premature failure of the refrigeration system overall. Ms. Nunn attempted to resolve the issues informally pre-litigation, but the developer and contractors' attempts to fix the systemic defects were ineffective. Negotiations halted after the developer refused to budge from a low, walkaway offer. Litigation commenced and after two years of investigation into both the defective design and construction of the cold storage facility, as well as defective geotechnical and civil construction causing failures in the building’s concrete tilt up panels and the concrete/asphalt hardscape, MPG’s construction team obtained a robust, multi-million dollar settlement for the client.
