Adam Wieder obtains a complete defense verdict on behalf of Western Computer.


In a recent arbitration, Adam Wieder obtained a complete defense verdict on behalf of Western Computer, a leading reseller of Microsoft Dynamics ERP solutions, after it was sued by a large flooring company based in Texas.  The Plaintiff asserted claims for fraud, negligent misrepresentation, and breach of contract arising from the Western Computer’s implementation of an Enterprise Resource Planning system, and sought over $1.5 million in damages.  The Plaintiff claimed that Western Computer made numerous false representations about its expertise in software implementation in order to induce Plaintiff to enter into a contract, but it never had the knowledge, skill, or ability to perform as it promised.  The Plaintiff further alleged that after paying nearly a $1 million in fees, it was forced to discard the ERP system because it did not work.  After an eight-day arbitration, the Arbitrator ruled in Western Computer’s favor on all claims and awarded it fees and costs incurred in the arbitration.
