DONNA B. NOUSHKAM
Donna B. Noushkam is a partner in the Orange County office of Musick, Peeler & Garrett LLP. She is a seasoned litigator representing public and private entities in complex civil matters, including disputes in the areas of construction, labor & employment, healthcare, product liability, contract, consumer warranty, consumer fraud and business torts.
In the labor & employment field, Ms. Noushkam handles litigation involving wage and hour law, leaves of absence, discrimination, discipline, and discharge issues. In addition, she has successfully defended cases involving wrongful termination, discrimination, harassment, retaliation, unfair competition, and intentional infliction of emotional distress before state and federal courts, and administrative agencies such as the California Department of Fair Employment and Housing and the U.S. Equal Employment Opportunity Commission. While Ms. Noushkam is a seasoned trial attorney, she also provides her clients with significant counseling and resources to avoid litigation. In the event a lawsuit can’t be prevented, she works to achieve economic victories for her clients by way of early motions to dismiss, summary judgment, and leveraging cases to produce nuisance value resolutions.
In the construction and development field, Ms. Noushkam has handled numerous cases involving alleged violations of wage and hour laws for private and public works projects, substantial contract and Miller Act bond claims, take-over agreements, wrongful termination of construction contracts, and other construction contract disputes. She has litigated matters involving design-build and guaranteed maximum price contracts, the False Claims Act, prevailing wage assessments and audits, delay damages, construction defects, mechanic’s liens, professional design liens, and stop notices.
Ms. Noushkam has served as lead counsel in multiparty lawsuits involving high-profile clients as well as trial counsel for several publically traded companies and public entities. She has successfully defended numerous multi-million dollar disputes and has obtained favorable settlements. She is admitted to practice in all the state and federal courts of California and the United States Court of Appeals for the Ninth Circuit. Ms. Noushkam is member of the Orange County Bar Association, and Mexican American Bar Association.
