Musick Peeler's Environmental & Public Law Group covers all aspects of environment law including compliance, remediation, enforcement and litigation, as well as land use and environmental insurance coverage. The Group is experienced in handling complex environmental issues encompassing:
  • Negotiation and drafting of consent orders, corrective action agreements, administrative compliance orders addressing obligations to clean up contaminated properties, and the sharing of environmental liabilities
  • Representation throughout the remediation process, including negotiating approval of economically feasible remediation plans
  • Representation during enforcement proceedings involving civil or criminal charges
  • Counseling with respect to federal and state laws governing hazardous waste management, solid waste management, medical wastes, air and water pollution, contamination and spill reporting, community "right to know" requirements, historic preservation, occupational health and safety, underground storage tanks, Proposition 65, PCBs, MTBE, wetlands and mineral resources

  • Environmental litigation cost recovery and contributions actions against persons potentially responsible for property contamination, including claims concerning insurance coverage for environment damages as well as actions for and against government agencies relating to the administration of environmental regulations
  • Preparation and review of environmental impact statements for site selection and development of land use projects such as industrial facilities, solid and hazardous waste management facilities, office building, shopping centers, residential complexes, hotels, civic centers and sports facilities
  • Indoor air quality problems and asbestos management, including compliance with regulations, contracting for abatement and removal, and apportionment of liability for asbestos-related claims
