Peter Diedrich and Jennifer Kalvestran prevail in summary judgment07.09.2009In April 2009, Peter Diedrich, assisted by associate Jennifer Kalvestran, prevailed on a partial motion for summary judgment in federal court in Los Angeles, in which the opposing party sought damages approximating $10 million. Plaintiff brought a motion seeking judgment on the ground that defendant (our client) had wrongfully “converted” plaintiff’s database to its own use by failing to return the database when the parties’ licensing agreement was terminated. In opposition, we argued in essence that traditional conversion concepts didn’t apply to a database under our facts, and that plaintiff’s conversion claim should be dismissed. Judge Morrow of the District Court agreed with us and dismissed plaintiff’s claim. The remainder of the case settled within a few days.
