William Miller, Cheryl Orr and Lourdes de la Cruz prevail with motion for summary judgment in healthcare antitrust class action03.08.2009Summary Judgment was granted to a healthcare trade association on a motion prepared by William Miller, Cheryl Orr and Lourdes de la Cruz. The motion was prepared on behalf of all defendants in a major class action and had the attention of the hospital industry. The claim was that the healthcare trade association had been “the hub of a conspiracy to fix the wages of 12-hour shift nurses to avoid the overtime rules enacted in 1999.” The Motion for Summary Judgment was based upon the Plaintiff's failure to present any evidence of such a conspiracy. Judge Carl West found in favor of the defendants on all of the material issues in dispute.
